Chem-Dry Store Terms & Conditions of Sale

These conditions may be amended from time to time by us, please visit our website on a regular basis to ensure you are aware of any changes made by us. Any revised version of these Terms shall be effective immediately from when they are displayed on this website.

These terms and conditions including the documents or other sources referred to in these terms and conditions supersede all prior representations, understandings and agreements between you and Chem-Dry relating to the use of this website (including the order of products) and sets forth the entire agreement and understanding between you and Chem-Dry for your use of this website.

1. Conditions relating to the Sale of Products to you

This part deals with sections relating to the sale of products by Chemdry.co.uk to you.

For the purpose of these terms and conditions, the terms 'product, products, item or items' can be defined as any product we sell on this website, whether it is an individual product, consumable can, carpet accessories or bundled kit packages.

We will only accept orders from UK addresses and only deliver to UK addresses. We are able to accept orders for the following locations: England, Northern Ireland, Scotland, Wales, Channel Islands, Isle of Man, Isle of Wight and the Scottish Highlands.

2. Product Application - Health & Safety

Chem-Dry is committed to selling quality consumable products that are highly effective and specially formulated to achieve maximum results. Please make sure you always use the right stain removal product, for the stain you are attempting to remove. There is no guarantee all stains will be successfully removed.

Please use any Chem-Dry product only as directed. Chem-Dry and Chem-Dry Franchises can't be held responsible for damage through misuse and improper application. You should refer to the 'How to Use' Fact Sheets or the reverse of the product for specific health and safety and cautions.

All sizes and measurements are approximate, but we do try to make sure that they are as accurate as possible.

3. Our Contract - All Online Transactions

The 'Confirm your purchase' page on the Chem-Dry store sets out the final details of your order. When you place an order and purchase a product from chemdry.co.uk/store, we will send you an email confirming receipt of your order and details of the order you have placed.

Your order represents an offer to us to purchase a product which is accepted by us when we send email confirmation to you that we've dispatched that product to you (The confirmation email). That acceptance will be complete at the time we send the Confirmation Email to you. Any items on the same order, which we haven't dispatched and confirmed on the Confirmation Email, will not form part of this contract.

Please print out these terms and conditions and the order acknowledgement for your own records.

4. Electronic Communications

When you visit Chemdry.co.uk or send emails to us, you are communicating with us electronically. We communicate with you by email or by posting notices on the website. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

5. Children

Chemdry.co.uk does not sell products for purchase by children. If you are under 18, you may use Chemdry.co.uk only with the involvement of a parent or guardian.

6. Alteration of Service or Amendments to the Conditions

We reserve the right to make changes to our website, policies, and these Conditions of Use & Sale at any time. You will be subject to the policies and Conditions of Use & Sale in force at the time that you use the website or that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

7. Events beyond our reasonable control

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control a "Force Majeure Event".

A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:

  • Strikes, lock-outs or other industrial action;
  • Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;
  • Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster;
  • Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;
  • Impossibility of the use of public or private telecommunications networks; and the acts, decrees, legislation, regulations or restrictions of any government.

Chem-Dry's performance under a Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. Chem-Dry will use its reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.

This condition does not affect your statutory rights.
